These Terms apply to your use of the brainexy.com website and, unless superseded by a Service Agreement, to any preliminary or pilot services.

4. Pilot Engagements

Brainexy offers 14-day pilot engagements at no charge for evaluation purposes. Pilots are provided "as is" without warranty. Brainexy makes no commitment that a pilot will continue beyond its stated term or that the results will be replicated in a paid engagement. Pilot data is deleted within 30 days of pilot completion unless a paid engagement is initiated.

5. Confidentiality

Any non-public information you share with Brainexy during an evaluation, pilot, or engagement ("Confidential Information") will be treated as confidential and used only to provide or evaluate our services. Brainexy will not disclose your Confidential Information to third parties except as required by law or with your consent. You agree to treat as confidential any non-public information Brainexy shares with you about our technology, processes, or pricing.

6. Disclaimers

THE BRAINEXY WEBSITE AND ANY PILOT SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BRAINEXY DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI agents are software systems and may produce incorrect, incomplete, or unexpected outputs. You are responsible for validating agent outputs before acting on them, particularly for high-stakes business decisions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRAINEXY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BRAINEXY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR YOUR USE OF THE WEBSITE WILL NOT EXCEED USD $100.
